Scope and school agreements

These terms describe authorised educational use of NethGuide, presented by Elokins Innovation & DigiPolis. This review edition is subject to operator and legal approval; browsing it does not constitute recorded acceptance of a school contract.

School subscriptions, data-processing responsibilities, pricing, service commitments and support arrangements are set out in the applicable school agreement. Mandatory legal rights and approved school agreements take precedence over inconsistent provisions here.

02

Accounts and adult authorisation

Use only an account you are authorised to access and keep credentials private. Schools and families must arrange required child authorisation, accurate supporter links and appropriate supervision. Report suspected unauthorised access to your school’s designated lead for escalation to the platform administrator.

Do not impersonate a learner or supporter, share passwords, or obtain access to another student’s records. Role choices at sign-up do not entitle anyone to protected administrative access.

03

Educational support, not professional judgement

NethGuide offers task support, learning tools, calming activities, original educational games, communication and reporting. It is not a medical, diagnostic, legal or emergency service. AI feedback can be wrong; learners should be supported by responsible adults and qualified professionals where necessary.

Teachers and other qualified staff remain responsible for curriculum decisions, accommodations, assessment and formal IEP/504 or support-plan approvals. Family review or an AI suggestion is not a substitute for that approval. Schools must check suitability for each learner, including accessibility and safeguarding needs.

04

Acceptable use and child protection

Treat others respectfully. Do not bully, threaten, exploit or groom a child, share unlawful or abusive content, bypass access controls, distribute malware, or access private records without permission. A learner seeking help about harm or abuse should be supported, not penalised for disclosing a concern. Do not publish sensitive learner information without authority.

Detected child-protection concerns in learner messages and text conversations with Neth automatically create restricted safety records and in-app notifications to the learner’s designated linked support staff, teachers or parents. Recipients must review and respond under their safeguarding procedures. Keep supporter links accurate, and report concerns directly to a trusted adult or safeguarding lead. Automated alerts assist adult oversight; they are not emergency monitoring. In immediate danger, contact local emergency services.

05

Your work, uploads and external documents

Learners and other rights holders retain their rights in work they submit. Upload or link only content you have permission to use and disclose. Permission to the operator is limited to processing that content to provide the agreed service, subject to the school agreement and applicable privacy notice; no ownership transfer is intended.

Google Docs and other external sites have their own permissions and terms. A link does not grant a teacher access automatically. Schools and families remain responsible for selecting appropriate sharing settings and avoiding public disclosure of children’s data.

06

NethGuide and third-party intellectual property

NethGuide’s original software, design, written materials, framework and brand belong to their respective owners or licensors. Authorised users may use them for the agreed educational purpose. Do not copy or commercially redistribute the platform or its brand without permission, except where a legal right or applicable licence permits it.

Third-party software and assets remain subject to their own licences. The games added to this app are original NethGuide activities, not imported ABCya games. References to ABCya, IB, AISA or legislation do not imply affiliation, endorsement or certification. No patent or trademark registration is asserted by these terms.

07

Privacy, safeguarding and records

The privacy policy explains how learner information, support records, AI requests and safeguarding indicators are handled. School agreements specify the applicable processing responsibilities, authorisations, retention and transfer safeguards. FERPA, COPPA, UK/EEA data protection and other local requirements apply according to the school and learner’s circumstances.

Use your school’s privacy lead or linked support team for access, correction, export or deletion enquiries and escalation to the operator. Share safeguarding and health information only through authorised private channels. School record obligations may affect deletion.

08

Availability, changes and account closure

NethGuide depends on network connectivity, device permissions and its service providers. Maintenance and interruptions may affect availability. Additional messaging channels, including WhatsApp, depend on configuration and delivery conditions. Service commitments are governed by the applicable school agreement; the platform is not an emergency response service.

Material changes, account closure, export arrangements and record retention are handled under the applicable agreement and mandatory law. Any subscription pricing, refunds and cancellation rights must be communicated before purchase. Statutory consumer rights are not waived.

09

Liability, disputes and final review

Nothing in these terms excludes rights or liabilities that cannot lawfully be excluded, including mandatory consumer protections. Any agreed liability provisions and dispute procedures are governed by the applicable contract and law.

This review edition does not establish a new governing-law or dispute-resolution clause. Those arrangements and the legal operator’s contact are supplied in the approved agreement before final adoption.
